Breyer State University is a licensed school by the Department of Post-Secondary Education of the state of Alabama, having met all criteria and requirements defined by the law for Postsecondary Education and Private School Licensing.
Breyer State University is licensed pursuant to the Alabama Private School License Law, Code of Alabama, Title 16, chapter 46, 1 through 10. Licensure in the State of Alabama represents authority to operate as an educational institution.

A brief list of major categories of standards and regulations for Post-Secondary School Licensing include:
- Evidence of compliance to State and Federal Laws.
- Financial security and viability of the university including surety performance bonding.
- Comprehensive student policies in compliance to the state laws and regulations.
- Office facilities and education resources to accommodate all instruction.
- Credentialed faculty to provide instruction and meet course and program objectives.
- Evaluation of the administration of the school including its policies/procedures of academic and business operations.
- Submission and review of all course materials and program materials and objectives to support academic preparation that meets the educational needs according to stated objectives of each course.
- Adherence to school rules by the department that each course, curriculum and instruction is consistent in quality and content with recognized school standards determined by the department of Postsecondary Education.
- Review of faculty resources and policy/procedures for instruction.
- Review of credit hour awards, semester hour awards and transfer credit policies.
- Factual statements of accreditations.
- Facilities and processes for maintaining full student records.
- Review of grading scales and evaluation methods of course work.
- Review of financial records according to accounting procedures accepted by the department.
- Appropriate and factual content of all school catalogues and advertising materials.
- Adherence to the department’s standards for credit hours of instruction, credit hour requirements for degree programs and laboratory and externship courses.
- Resources and references for students, including library resources are available.
- Appropriate terms of admissions and enrollment for students.
- Adherence to department standards for tuition refunds.
- Review of personal data of each administrator, director, supervisor, instructor and agents of the school.
- Submission of Breyer State University to scheduled or non-scheduled onsite inspections by the Department of Education.
