SYLLABUS

COURSE OVERVIEW: Welcome scholars, to Legal Aspects of Justice, a Post-Graduate Level course in the curriculum for the Degree, Doctor of Criminal Justice. I am pleased to instruct you in this specialty course, which will be applied towards your requirements of your studies in the doctoral program.

This is an extremely exciting course that delves into the most contemporary legal issue of our times. This updated eleventh edition of Taking Sides: Legal Issues is designed to immerse students in controversies in the law. The readings, which represent the arguments of leading legal scholars, judges, and legal commentators, reflect a variety of viewpoints and are staged as "pro" and "con" debates. Issues debated include the operation of legal institutions; law and social values; and law and crime.

Part one of the course deals with Law and the individual and will examine recent issues argued before the Supreme Court including, in part, abortion; restrictions on physician-assisted suicide, the right for people to clone themselves and Internet music piracy; insanity; and pretextual stops.

Part two of the course involves issues of law and the State and examines modern conflict of church and state; the 4th Amendment and thermal imaging devices; constitutional limitations on internet access in our schools; the imposition of the death penalty on mentally retarded; California's Three Strikes law put to the test; the 4 th Amendment and mandatory drug testing of students.

Part three deals with law and the community and examines the First Amendment rights of punished fraudulent companies; testing the constitutionality of contemporary cross-burning prohibitions; are laws criminalizing homosexual conduct unconstitutional; questions the liability of school officials for student-to-student sexual harassment; Should students with disabilities be given extraordinary care or ordered to attend public school classes; Do Race-Conscious Programs in Public University Admissions Policies Violate the Fourteenth Amendment's Guarantee of Equal Protection Under the Law? I know you will enjoy this fascinating and contemporary course.
